TERMS, CONDITIONS, LIABILITY WAIVER & SAFETY POLICY

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern all diving activities, courses, guided dives, coaching sessions, experiences, and related services (collectively referred to as “Activities”).

By booking, paying for, or participating in any Activity, you confirm that you have read, understood, and agreed to these Terms in full.

Participation constitutes acceptance of this agreement.

If you do not agree with any part of these Terms, you must not participate.

2. Nature of Activities & Assumption of Risk

Scuba diving and related water activities involve inherent and unpredictable risks, including but not limited to:

  • decompression sickness
  • barotrauma
  • drowning
  • equipment malfunction
  • marine life interactions
  • environmental hazards
  • slips, falls, or physical injury
  • panic reactions
  • remote location risks
  • permanent disability or death

By participating, you acknowledge and voluntarily assume all risks associated with diving activities, whether known or unknown, foreseeable or unforeseeable.

You confirm that participation is voluntary and at your own risk.

3. Medical Fitness & Responsibility

Participants must be medically fit to dive.

You agree to:

  • provide truthful and complete medical information
  • disclose any injury, illness, medication, or condition
  • complete required medical questionnaires
  • obtain medical clearance if requested

Failure to disclose relevant medical information releases the service provider from liability.

We reserve the absolute right to refuse participation if any safety or medical concern exists.

4. Alcohol, Drugs & Intoxicating Substances

Participation in diving activities under the influence of alcohol, drugs, narcotics, or any impairing substances is strictly prohibited.

We reserve the absolute right to refuse participation, cancel dives, or terminate services without refund if a participant appears impaired or under the influence.

All decisions made for safety reasons are final.

5. Safety Authority

Participants must follow all instructions, briefings, and professional guidance at all times.

The instructor has full authority to modify, suspend, or terminate any activity if safety is compromised.

Failure to follow instructions may result in immediate termination without refund.

6. Booking & Confirmation

Bookings are confirmed once dates, services, and availability are agreed in writing (WhatsApp or email) and any required deposit is received.

Deposits secure dates and are generally non-refundable unless otherwise agreed.

7. Pricing & Additional Costs

Prices displayed represent indicative or starting prices only.

Final pricing may vary depending on:

  • private vs semi-private format
  • logistics
  • equipment requirements
  • site access or marine park fees
  • boat trips
  • transportation
  • certification fees
  • scheduling adjustments

All final pricing will be confirmed prior to service delivery.

8. Payments

Payment method and timing will be agreed individually.

Failure to complete payment may result in cancellation of services.

9. Cancellation & Rescheduling

Activities may be modified or cancelled due to weather, sea conditions, operational requirements, or safety considerations.

Deposits are generally non-refundable but may be transferable at our discretion.

Failure to attend without notice may result in full loss of payment.

10. Refusal or Termination of Participation

We reserve the right to refuse or terminate participation without refund if:

  • safety concerns arise
  • medical concerns are present
  • intoxication is suspected
  • behaviour is unsafe, aggressive, or disruptive
  • instructions are not followed
  • documentation is incomplete

11. Independent Operator Status

Services are provided independently and may involve coordination with third-party providers such as boats, transport, or facilities.

We are not responsible for the actions or omissions of third parties.

12. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any:

  • injury or death
  • property loss or damage
  • travel disruption
  • indirect or consequential loss
  • delays or cancellations
  • acts of third parties
  • environmental conditions
  • participant negligence

Participation is entirely at your own risk.

13. Indemnification

You agree to indemnify, defend, and hold harmless the instructor, assistants, contractors, and partners from any claims, liabilities, damages, losses, or expenses arising from:

  • your participation
  • your negligence
  • failure to follow instructions
  • undisclosed medical conditions
  • breach of these Terms

14. Insurance

Participants are strongly advised to maintain valid dive insurance covering:

  • diving activities
  • emergency medical treatment
  • evacuation
  • travel disruptions

Participants remain fully responsible for their own insurance coverage.

15. Environmental & Operational Conditions

Dive plans may change due to weather, currents, visibility, or environmental factors.

Safety decisions are final.

16. Media Consent

Photos or videos may be taken during Activities.

By participating, you consent to the use of such media for promotional purposes unless you request otherwise in writing prior to participation.

17. Force Majeure

We shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:

  • weather events
  • natural disasters
  • government actions
  • travel restrictions
  • illness
  • equipment failure
  • civil disturbances

18. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Arab Republic of Egypt.

Any disputes shall be subject to the exclusive jurisdiction of Egyptian courts.

19. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force.

20. Entire Agreement

These Terms constitute the entire agreement regarding participation in Activities and supersede any prior communications.
